Sheffield business taught a lesson on how to handle redundancies.
8 July 2008
Janine Birchley of Co-Operative Street, Rotherham received a substantial payout after she was unfairly dismissed by Approved Financial Solutions Ltd.
After 15 months working with AFS Janine was made redundant after AFS cited new business not reaching anticipated levels. This led her to make a claim against AFS which was brought before an employment tribunal on 30th June. The tribunal lasted for a total of 2 days and the verdict reached was that although there was a redundancy situation, the process undertaken by AFS was unfair and that 1 of the directors of AFS had been biased in his assessment of Janine & the other candidate for redundancy. Janine was therefore awarded a total of £10,963 in compensation.
Liam Kenealy, employment solicitor at Ashton Morton Slack who prepared the case against AFS commented "I'm delighted for Janine. Even though the financial industry is going through tough times at the moment companies still need to be fair and follow a proper procedure when carrying out redundancies and do their utmost to prevent the loss of jobs. In Janine's situation this just was not the case and I am pleased the Tribunal saw it that way too."
Janine's partner, Russell Paul was fulsome in his praise, "Obviously it's been an extremely stressful time for both of us over the last 5 months or so and when we instructed Liam to act for us it was a massive relief. It's well known that when dealing with most solicitors, that you have to call them every day and when you do, that they never return your calls and we were delighted that Liam was the complete opposite of that. We can't credit him enough for that."
