Plane crashes in Goma

A Congolese plane has crashed whilst attempting to take off from Goma, killing more than 30 people. The accident happened in a busy residential area. Fortunately plane accidents of this magnitude are an extremely rare occurance, however still devestating for all those involved.
As such there is a great responsiblity on all airlines for the passengers they carry, and because of the likelihood of injury in the event of a plane accident, many countries throughout the world (including the UK) have now incorporated the Montreal Convention into their legal systems.
The Montreal Convention confirms that compensation for personal injury or death may well be payable regardless of whether the airline was actually responsible for the accident, provided the Country you are flying to or from is a signatory to the agreement, and provided a claim is made within two years of the date of the accident.
The sum awarded would depend on the nature and severity of the injury, however if the claim is valued at less than approximately £68,000.00, then the airline cannot exclude or limit its liability for proven damages.
