Rock climber seriously injured in fall

A climber has been seriously injured after falling 50 feet whilst rock climbing on holiday in Dartmoor.  He was airlifted to hospital where he remains in a critical condition.

Outdoor pursuit holidays are extremely popular in the UK however by their very nature carry their own risks and hazards.  What many people may not be aware of is that if you are injured whilst on holiday in the UK, a claim for compensation may still be possible under the Package Travel, Package Holiday and Package Tour Regulations 1992, provided a claim is made within 3 years of the accident.

Regulation 2(1) confirms that a 'package' holiday means the pre-arranged combination of at least two of the following when sold or offered for sale at an inclusive price:

1.Transport

2. Accommodation

3. Other tourist services not part of transport or accommodation and accounting for a significant proportion of the package.

The holiday must also last for more than 24 hours or include overnight accommodation for a claim under the Package Tour Regulations to be considered.

So for example, if you have booked a climbing holiday in the UK and the cost of your holiday included coach travel to the destination, accommodation whilst there and a guided tour whilst out climbing, if you then suffer an injury a claim under the Package Tour Regulations may be viable.
