Enforcing restrictive covenants

Protecting your business is vital.  Therefore if ex-employees are in breach of contractual terms prohibiting them from enticing customers or employees, working for rival companies or setting up in competition with you, then our employment and dispute resolution teams can ensure that measures are taken to ensure no damage is done to your company.

The general presumption is that such clauses are illegal. If, however, you can show that the covenant protects a legitimate business interest and is not too wide in its prohibitions then you may be able to enforce it. The most common remedies damages for loss sustained to your business and injunctions preventing an individual from acting in breach of such a restrictive covenant.
