Equal pay and your legal rights

If you are carrying out the same work, or equivalent, as a colleague of the opposite sex and are receiving a lesser salary than they are and you believe that your gender is the only reason contact us at Ashton Morton Slack to discuss how we can help you rectify the situation. Although it is more common that female employee's are paid less than their male colleagues it can also be the other way round. If you are being paid less than a colleague who does the same or equivalent job as you and you are of the same sex then you cannot bring a claim for equal pay.

When a claim for equal pay is brought it is for the employer to prove that any difference in salary is for a reason other than gender. Initially the claim should be brought through your employer's grievance procedure and should be followed through to its conclusion. If the outcome is not the one you desire then it may be possible to bring a claim at the Employment Tribunal. You can bring a claim for Equal Pay at any time up to 6 months after you leave the company.

We are happy to have an initial telephone discussion without charge on any matter. We aim to have a clear and flexible approach to funding options, therefore we can provide an outline of what the estimated cost may be at the outset.  This allows you to assess at an early stage whether it is financially viable to pursue the matter.   For more details on the funding options available please click here.
