Advice on funding your employment case

An employment matter that goes all the way to an Employment Tribunal can cost upwards of £5,000.  In the majority of cases this amount cannot be recovered regardless of the outcome.  It is vital therefore to assess at an early stage whether it is financially viable to pursue the matter.  Ashton Morton Slack can provide an outline of what the estimated cost may be at the outset.  There are also other methods of funding:-

 

            1)         Legal Expense Insurance

 

                        - Most employees have some sort of insurance policy whether it be House (Contents and Buildings) Insurance, Car Insurance or even Pet Insurance.  A lot of insurance companies also include as part of the policy Legal Expenses Insurance which usually covers employment disputes.  The policy will usually only be applicable should the prospects of success be at least 51%.  A lot of insurance companies will try and recommend a firm of solicitors who they have on their panel but you are entitled to choose whichever firm of solicitors you like and Ashton Morton Slack have acted on many occasions for individuals with the benefit of Legal Expenses Insurance.

 

            2)         No Win, No Fee

                        - Depending on the merits and the value of your claim as well as your means Ashton Morton Slack can offer a ‘no win, no fee' arrangement.  If unsuccessful you pay nothing other than disbursements incurred on your behalf.  If successful we receive a pre-arranged percentage of your settlement.  Given that the merits and value of a claim can change throughout the course of a matter Ashton Morton Slack will constantly review your case and will only continue if we believe your case has a reasonable prospect of success.

 

            3)         Private Payment

                        - You pay for the legal work yourself at Ashton Morton Slack's hourly rates which vary depending on the seniority of the solicitor dealing with the matter.

 

It should be noted that Legal Aid is not available for employment matters.
